JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06.12.2017 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Earlier prayer for bail of the petitioner was rejected by this court but again, bail is sought on the ground that petitioner is in jail custody since 19.5.2015 whereas having more or less similar allegation co-accused Lalu Kumar Yadav @ Lalo Yadav @ Lalu Yadav @ Lao Yadav has already been granted privilege of bail by a coordinate bench of this court vide order dated 4.9.2017 passed in Cr. Misc. no. 37040/2017.

Trial court has reported that trial of the petitioner is pending for framing charge which could not be framed as the petitioner is languishing in central jail, Madhepura.

No.53652 of 2017 (3) dt.06-12-2017 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri Ashok Kumar, Judicial Magistrate, Ist Class, Uda Kishunganj, District Madhepura in Gwalpara (Arrar O.P) P.S. Case no. 01/2015.
