JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-11-2015 Heard learned counsels for the petitioner and the State. The petitioner being the Rojgar Sewak is apprehending arrest in a case registered for the offences punishable under Sections 409 and 420/34 of the Indian Penal Code. It is alleged against the accused persons including the petitioner that they misappropriated the money under the MNREGA Scheme Nos. 3,4 and 5 of 2011-12.

It is submitted by learned counsel for the petitioner that the petitioner has deposited back the amount alleged to have been misappropriated by this petitioner.

Considering the aforesaid facts, let the above named petitioner be released on provisional anticipatory bail for two months, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail

Patna High Court Cr.Misc. No.51884 of 2015 (2) dt.10-11-2015 2/2 bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Begusarai in connection with Nayagaon P.S. Case No. 38 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.

The provisional bail of the petitioner will be confirmed by learned court below on verification of the fact that the petitioner has deposited the amount alleged against him. (Dinesh Kumar Singh, J) Amrendra/- U T
