The petitioner apprehends his arrest in Warisaliganj P.S. Case No.19 of 2021, registered for the offence punishable under Section 414 of the Indian Penal Code.

Four stolen vehicles are said to have been recovered near the Bathan of the petitioner.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that the petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application. No incriminating article has been recovered from the conscious possession of the petitioner.

On the other hand, learned APP for the State opposes

Patna High Court CR. MISC. No.52678 of 2021(2) dt.10-05-2022 2/2 the prayer for anticipatory bail of the petitioner and submits that four stolen vehicles have been recovered near the Bathan of the petitioner.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.

However, if petitioner surrenders before the learned court below within a period of six weeks from today and seeks regular bail, the learned court below shall consider the prayer for regular bail of the petitioner preferably on the same day without being prejudiced by this order.
