2. The petitioner seeks bail in Bagaha P.S. Case No. 551 of 2022 corresponding to Sessions Trial No. 938 of 2022 registered under Sections 304(B)/34 of the Indian Penal Code.

3. The prosecution case in short is that marriage of the deceased was solemnized with the petitioner in the year, 2020. Admittedly, it was a love marriage. As per allegation mentioned in the FIR, the accused persons including the petitioner subjected the deceased to torture for non-fulfillment of demand of dowry and ultimately, the petitioner and other matrimonial inmates committed her dowry death by strangulating her.

4. Learned counsel for the petitioner has submitted that the

Patna High Court CR. MISC. No.57454 of 2023(7) dt.17-09-2024 2/2 petitioner is husband of the deceased. The deceased died five years after her marriage. Admittedly, it was a love marriage. As such, there is no reason for the husband to commit dowry death of the deceased. Learned counsel for the petitioner has also submitted that the injury report itself shows that during treatment, the deceased died in Sub Divisional Hospital which indicates that before death, the treatment of the deceased was going on.

5. Learned Counsel for the State opposed the prayer for bail.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-Ist, Bagaha, West Champaran in connection with Bagaha P.S. Case No. 551 of 2022 corresponding to Sessions Trial No. 938 of 2022 subject to the condition that the petitioner shall cooperate with the trial and make himself available as and when required by the court.
