JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 04-10-2018 Pursuant to the last order dated 26.09.2018, the Principal, Government Polytechnic, Gaya and the Director, Science and Technology, Government of Bihar are present in person.
It appears from their statements that the Principal has forwarded the pension papers of the petitioner on 26.09.2018 and thereupon the Director, Science and Technology sent it to the Special Secretary, Department of Science and Technology, Government of Bihar who has in turn now sent the papers to the
Patna High Court MJC No.2999 of 2014 (21) dt.04-10-2018 office of the Accountant General, Bihar. The Accountant General is opposite party no.3 in the present case. However, nobody is appearing on his behalf. It is pointed out that the name of the learned advocate representing the Accountant General, Bihar is also not appearing on the cause list.
In the given circumstance, instead of adjourning this matter, this Court is disposing of the contempt application with an expectation that the Accountant General, Bihar shall not sit over the matter now and will do the needful within ten days from the date of receipt/production of a copy of this order and the authorization will be sent to the treasury within the prescribed period whereupon the treasury officer shall be obliged to do the needful towards payment within three days, failing which they will be liable to be proceeded against. If the petitioner does not receive the payment in terms of the order of the learned Writ Court, despite the aforesaid observations within the prescribed period, he will be free to file an application in the present case bringing all those facts to the notice of this Court.
