JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-11-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 323, 341, 379, 354 of the Indian Penal Code.
It is alleged that petitioner entered into the house of the complainant and abused her. On protest being made the complainant was assaulted and stripped. It is submitted by learned counsel for the petitioner that petitioner was on inimical terms with the complainant from before as the petitioner purchased some land from the agnate of the husband of the complainant, for which Title Suit No. 288 of 2014 was filed, wherein the petitioner is defendant No. 3 and husband of complainant is defendant No. 6.
A statement has been made in para 3 of the
Patna High Court Cr.Misc. No.53204 of 2015 (2) dt.26-11-2015 2/2 petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Saran at Chapra in connection with Complaint Case No. 3357 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
