Mr. SRI RAJEEV NAYAN ====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 13-12-2017 Heard learned counsel for the petitioner and the State. This is an application for regular bail in connection with Sonepur P. S. Case no. 63 of 2017 registered for the offences punishable under Sections 302 r/w 34 of the Indian Penal Code. According to informant, his brother had given Rs.5 lacs to Ramesh Rai and Rs.4 lacs to Raju Singh and Baliram Singh. On demand, Raju Singh and Baliram Singh along with two unknown persons came and paid only Rs.17,000/- and took away the deceased to the house of Ramesh Rai. Later on, the deceased was murdered.

It is submitted on behalf of petitioner that he has falsely been implicated in this case. There is no specific overt act against him. He is in custody since 31.05.2017 and has got no criminal antecedent.

No.49899 of 2017(3) dt.13-12-2017 2/2 Learned counsel for the State opposes prayer for bail of the petitioner submitting that witnesses have supported the prosecution case in paras-9, 10, 11 of the case diary. Petitioner is named in the FIR and police has found the case to be true. Considering the facts and circumstances of the case, I am not inclined to grant bail to the petitioner. His prayer is accordingly rejected.
