The petitioner is in custody since 18.09.2017 in connection with Madanpur P.S. Case No. 214 of 2017 for the offence registered under Sections 395, 397, 328, 412 of the Indian Penal Code.

Learned counsel for the petitioner submits that two trucks had collided and one Satendra Kumar Saw, driver of one of the trucks had been demanding compensation. The petitioner being a bystander, who was watching the occurrence, was apprehended as being one of those persons, who was also the person of demanding the said compensation. On the basis of his confession, the petitioner is now being prosecuted, which is not

Patna High Court Cr.Misc. No.58915 of 2017 (2) dt.14-12-2017 2/2 admissible in evidence. It is further submitted that no incriminating article has been recovered from the conscious possession of the petitioner and till date no T.I. Parade has also been conducted.

Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S. Case No. 214 of 2017.
