2. In the present case, the petitioner seeks bail in connection with Khaira P.S. Case No. 216 of 2024, registered for the offence under Section 309(4) of BNS.

3. As per the prosecution case, four unknown miscreants on two motorcycles overtook the motorcycle of the informant and looted his motorcycle, Rs. 1,27,000/-, mobile phone and other articles. The name of the petitioner transpired during investigation for being involved in the robbery.

4. The learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. Nothing incriminating has been recovered from the person/possession of the petitioner. The name of the petitioner

Patna High Court CR. MISC. No.44074 of 2026(2) dt.08-07-2026 2/3 came up in this case on the basis of confessional statement of co-accused Ajay Kumar. The co-accused and this petitioner belong to the same village and there is dispute over drainage between them and for this reason, the co-accused has named this petitioner in the present case. Similarly placed co-accused has been granted bail vide order dated 16.10.2025 passed in Cr. Misc. No. 72831 of 2025 by learned Coordinate Bench of this Court. The petitioner is in custody since 16.03.2026 and is having antecedent of one case. The charge sheet has been submitted.

5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner.

6. Having regard to the fact and circumstances and submission made on behalf of the parties and considering the fact that no recovery has been shown from the petitioner and further considering the submission of charge sheet against the petitioner and his period of custody, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate1st Class, Saran at Chapra/court concerned, in connection with Khaira P.S. Case No. 216 of 2024, subject to the condition laid

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
