The petitioner is languishing in custody for the offence punishable under Section 304B/34 of the Indian Penal Code.

The petitioner is husband of the victim of dowry death. The death was caused after five years of marriage for non-fulfillment of the dowry demand by the in-laws including the petitioner.

It appears that the petitioner is in custody since 20.07.2015. This Court while refusing prayer for bail for the second time on 11.04.2018 in Cr. Misc. No.20290 of 2018 had directed the trial-court to conclude the trial within four months.

Patna High Court CR. MISC. No.71380 of 2018(8) dt.11-04-2019 2/2 However, the report of the learned trial Judge dated 02.03.2019 reveals that the trial is still at the stage of prosecution evidence. Considering the entire facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with S.T. No.121 of 2016/228 of 2018, arising out of Amba P.S. Case No.48 of 2015, with condition that petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
