The petitioner seeks regular bail in connection with Jagdishpur P.S. Case No. 304 of 2018 registered for the offences punishable under Section 395 of the Indian Penal Code.

The allegation is regarding the accused persons having committed loot of Bolero vehicle. The learned counsel for the petitioner submits that the FIR is against unknown person, no Test Identification Parade has been held so as to connect the petitioner with the alleged crime and the petitioner is languishing in custody since 01.05.2019.

Lastly, it is submitted that similarly situated co-accused persons have already been granted bail

Patna High Court CR. MISC. No.39718 of 2019(3) dt.17-08-2019 2/2 vide order dated 26.10.2018 and 05.11.2018 passed in Criminal Misc. No. 64333 of 2018 and Criminal Misc. No. 66067 of 2018 respectively.

Having regard to the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Jagdishpur P.S. Case No. 304 of 2018.
