The petitioner apprehends her arrest in connection with Dighalbank (Korhobari) P.S. Case No.94 of 2014 (G.R. No.1264 of 2014) for the offences punishable under sections 304(B)/34 of the Indian Penal Code.

Even though Mr. Radha Mohan Singh, learned counsel appearing on behalf of the petitioner seeks to draw the advantage of the fact that the petitioner happens to be the mother-in-law but considering that the death of the deceased took place within seven months of her marriage and the allegation is of dowry demand and except that the father-in-law, mother-in-law and husband none was present in the house no case for anticipatory bail is made out.

This application is accordingly disposed of with a

Patna High Court Cr.Misc. No.52454 of 2015 (2) dt.14-12-2015 direction to the petitioner to surrender before the court below and pray for regular bail which shall be considered and disposed of on its own merits without being prejudiced by this order. (Jyoti Saran, J) SKPathak/- U T
