The petitioner seeks bail in Laxmipur P.S. Case No. 16 of 2016 for the offences instituted under Sections 147, 148, 149, 121, 121(A), 120(B) of the Indian Penal Code , 3, 4,5 of the Explosive Substance Act, 25(1-b)a, 26 of the Arms Act, 16, 18, 20, 21 and 22 of the Unlawful Activities (Prevention) Act. Earlier, twice the bail applications of the petitioner were rejected vide Annexure-1 and 2 respectively taking into account the fact that the petitioner is Naxal activist from whose possession, fire arms and detonators were recovered. A report was called for from the Trial Court. It has been reported that the Senior Scientific Officer, F.S.L., Patna is
Patna High Court Cr.Misc. No.70489 of 2018(3) dt.10-01-2019 2/2 only to be examined in the present case and the trial is expected to be concluded within a period of two months. Considering the nature of accusation and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected. The Trial Court is directed to conclude the trial at the earliest.
The Director, F.S.L., Patna is directed to ensure that the Senior Scientific Officer, F.S.L., Patna be produced on the date fixed by the Trial Court so that the trial could be completed within the stipulated period.
