The petitioner apprehends her arrest in connection with Hasanpur P.S. Case No. 200 of 2017, registered under Sections 304(B) and 201/34 of the Indian Penal Code, pending in the court of A.C.J.M.-III, Rosera, Samastipur. The accusation is of killing of daughter of the informant by her husband and in-laws due to non-fulfillment of demand of dowry and throwing her dead body in the ditch near the house.
Learned counsel for the petitioner submits that petitioner is mother-in-law of the deceased, daughter of the informant and she had gone to her Maika at the time of
Patna High Court CR. MISC. No.40004 of 2019(5) dt.27-09-2019 2/2 occurrence but with ulterior motive, petitioner has falsely been implicated in this case with false allegation. Having considered the facts and circumstances of the case and the nature of allegation, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, her prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial court within four weeks and pray for regular bail, which would be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
