JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 09-12-2022 Heard learned counsel for the petitioners, learned counsel for the Informant and learned APP for the State. The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 341, 323, 324, 307, 379, 447 and 504/34 of the Indian Penal Code. Allegedly, it is a case of assault upon the informant and his family members due to which, they sustained injury. It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that there is case and counter case between the parties and both parties have sustained injuries, as alleged, in separate occurrence. Injury report of the father of the informant

Patna High Court CR. MISC. No.43607 of 2022(2) dt.09-12-2022 2/2 is not available, so far as injury of informant Raman Kumar is concerned, the doctor concerned found lacerated injury only, which is simple in nature as mentioned in Annexure-3 to the petition and so far the injury of the brother of the informant is concerned, there is only lacerated wound on his head which is also simple in nature caused by hard and blunt object as mentioned in Annexure-4 of the petition.

Learned APP appearing for the State and the Informant have opposed the prayer for anticipatory bail. Considering the aforesaid submissions, let the petitioners, above named in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-I, Madhubani in connection with Khajauli P.S. Case No. 17 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
