1. Heard learned counsel for the petitioner and learned APP for the State.
2. The learned counsel for the petitioner submits that petitioner had earlier moved before this Court seeking regular bail by filing Cr. Misc. No.79460 of 2024 and the same was dismissed as withdrawn with liberty to the petitioner to renew his prayer for bail after framing of charge.
3. The learned counsel for the petitioner submits that charges against the petitioner has been framed by an order dated 30.05.2025.
4. Learned A.P.P. submits that though it has been pleaded in regular bail application that charges against the petitioner has been framed by an order dated 30.05.2025, but
Patna High Court CR. MISC. No.44240 of 2025(2) dt.04-07-2025 2/3 then, the order has not been annexed and thus, opposes the bail application.
5. Considering the submissions made by the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 50,000/- (Rupees Fifty Thousand) with two sureties of the like amount each to the satisfaction of learned Principal District and Sessions Judge, Sheohar/ Successor Court in connection with Sessions Trial No.38 of 2025 arising out of Piprahi P. S. Case No.267 of 2023, subject to the condition that one of the bailors of the petitioner shall be his nephew Sanjay Sha @ Sanjay Shah.
6. The application stands allowed.
7. It is made clear that the learned trial Court before releasing the petitioner on bail shall verify whether charges against the petitioner has been framed or not and in the event, if it is found that charges against the petitioner has been framed, in that event, the petitioner shall be released forthwith, but if it is found that charges against the petitioner has not been framed in that event, the present order shall not be given effect to.
8. However, in the event, if the learned trial Court comes to a conclusion that the petitioner after his release is trying to delay the trial in any manner, the learned trial Court
