Petitioners seek bail in Rajpur P.S. Case No. 96/2018, registered for the offences punishable under Section 302 and 34 of the Indian Penal Code.

Allegation is of committing murder of informant's daughter by the accused persons (in-laws) including the petitioners.

It has been submitted that petitioners have falsely been implicated in this case. Petitioners are Dewar of the deceased. There is general and omnibus allegation against them. Deceased committed suicide. Co-accused has been granted bail vide order

Patna High Court Cr.Misc. No.65110 of 2018 (3) dt.06-11-2018 2/2 dated 14.08.2018 passed in Cr. Misc. 50157/2018. Petitioners have no criminal antecedent. They are in custody since 04.07.2018.

Considering the facts aforesaid, the petitioners abovenamed, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VII, Buxar in connection with Rajpur P.S. Case No. 96/2018, subject to the conditions:

(1.) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2.) Petitioners shall co-operate in the trial and shall be properly represented on each and every date fixed by the court.

(3.) If the petitioners tamper with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners.
