The admitted position is that during pendency of this writ petition, challenging the initiation of proceeding, the petitioner has been awarded punishment in the proceedings which have been affirmed in appeal.

In view of such development subsequent to filing of this writ petition, writ petition has become infructous. All issues raised in the instant writ petition may well be considered in the proceedings arising out of later filed CWJC No. 4608 of 2015.

Patna High Court CWJC No.10889 of 2014 dt.24-08-2018 2/2 The second writ petition is also on list today and is being taken up for consideration.

The instant writ petition is therefore, dismissed as infructuous. (Madhuresh Prasad, J) Prakash/- AFR/NAFR CAV DATE Uploading Date Transmission Date
