The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 504 and 506/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has antecedent of one case and the informant alleges that on account of dispute relating to land, the occurrence took place and the petitioner came with Gandasa along with five other accused persons who were armed with lathi and stick etc. and dragged the uncle of the informant to his door and it is alleged that petitioner assaulted the uncle of the informant with Gandasa causing injury on his head. Further, it is alleged that Mit Narayan Yadav snatched his chain worth Rs.60,000/-. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.52704 of 2021(3) dt.04-07-2022 2/2 petitioner has been falsely implicated the present case. The present case is a counterblast to Khajauli P.S. Case No. 69 of 2020. It is next alleged that from perusal of the injury report of the injured which is annexed as Annexure-4 to the anticipatory bail, it would manifest that the injuries are simple in nature. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Khajauli P.S. Case No. 77 of 2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
