Heard learned counsel for the petitioners and the State through video conferencing.
The petitioners pray for grant of anticipatory bail in Narpatganj P.S. Case No. 363 of 2020 registered for the offence punishable under Sections 148/149/341/323/325/448/379/302/ 504 of the Indian Penal Code.
Altogether 18 persons are said to have assaulted the deceased, but no reason has been mentioned in the F.I.R. From the post mortem report, it appears that the deceased has received
Patna High Court CR. MISC. No.53758 of 2021(2) dt.15-02-2022 2/2 one lacerated wound and two abrasions. From the injury, it does not appear that the deceased was assaulted by 18 persons. It has been submitted that the entire neighbourhood has been made accused in this case and these three petitioners are own brothers having no connection with the occurrence and there is general and omnibus allegations against them. Considering the entire facts and circumstances of the case and also the fact that there is no chance of the petitioners absconding or tampering with the evidence during the course of trial, the present anticipatory bail application is allowed.
Accordingly, let the petitioners above named be released on bail, in the event of their arrest or surrender before the court below within a period of ten weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria, in connection with Narpatganj P.S. Case No. 363 of 2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
