JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-09-2022 Heard learned counsel for the petitioner and the State. Earlier prayer for pre-arrest bail was refused by this Court vide order dated 1.7.2022, passed in Cr.Misc.No. 63904 of 2021.

It is submitted by learned counsel for the petitioner that while hearing the case on 1.7.2022, the fact that petitioner at the time of recovery of alcohol from the vehicle was not present on the spot, rather he was on duty in the HDFC branch at Jamalpur, Munger, had not been brought on record. Learned counsel appearing for the State opposes the prayer for bail. He submits that prayer for pre-arrest bail of the petitioner was rejected by this Court on the ground that the vehicle from which there was recovery of huge quantity of illegal alcohol was registered in the name of the petitioner and

Patna High Court CR. MISC. No.43818 of 2022(2) dt.21-09-2022 2/2 so he cannot escape the responsibility.

As the petitioner has not made out any fresh ground, his prayer for bail is again refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
