2. Petitioner apprehends arrest in a case registered for the offences punishable under Section 363 of the Indian Penal Code.
3. According to F.I.R., petitioner is alleged to have kidnapped minor daughter of the informant.
4. Learned counsel for the petitioner submits that he has falsely been implicated in this case. As a matter of fact, petitioner and the daughter of the informant were in love and they have solemnized marriage in a temple and are peacefully living as husband and wife. It is next submitted that victim is major and according to the Aadhaar Card, her date of birth is 02.11.2001 (photocopy of Aadhaar Card of the victim annexed
Patna High Court CR. MISC. No.47426 of 2023(3) dt.20-09-2023 2/2 as Annexure-3 to the petition). Petitioner has got clean antecedent.

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Patna City in connection with Khusrupur P. S. Case No. 392 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that : 'One of the bailors will be victim/wife of the petitioner.'
