Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 115(2), 126(2), 118(1), 118(2), 303(2), 3(5) of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is a young man aged about 23 years and the informant alleges that wife of her land-lord, namely, Kanchan Devi snatched her mobile and chain, thereafter son of the landlord, namely, Himanshu (petitioner) came and touched her inappropriately and assaulted by sword causing injury on head.

The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that informant, who is staying as a tenant in the house of the petitioner, was having a relationship with his father, which was objected by his mother and when the informant did not listen to her mother, as such an altercation took place, in which both sides assaulted each other. It is further submitted that the petitioner intervened to separate his mother from the informant in which she fell. It is also submitted that even father of the petitioner supported the case of the prosecution, which amply demonstrates that he has soft corner for the informant on account of which the dispute had arisen. 5.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Jhajha P.S. Case
