The petitioners seek bail in connection with Wazirganj (Tankuppa) P.S. Case No. 486 of 2015 dated 26.11.2015 instituted for the offences under Sections 302, 201, 34 of the Indian Penal Code.

The wife of the deceased has alleged that because of her carrying a big load of articles on her head, she stayed back whereas her late husband and two others, namely the petitioners moved ahead. Later, when the informant reached her home, she did not find her husband.

The husband of the informant was later found to have been murdered.

The petitioners have been made accused in this

Patna High Court Cr.Misc. No.52724 of 2017 (3) dt.24-11-2017 2/2 case because they were last seen traveling/moving with the deceased. During the course of investigation, except for the fact that these two persons (the petitioners) were moving together along with the deceased were seen by some of the witnesses, no other incriminating material has come against the petitioners. The petitioners are in custody since 27.06.2017. The petitioners have no criminal antecedent.

Taking into account the aforesaid facts, this Court is inclined to grant bail to the petitioners. The petitioners, above named are directed to be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) each with sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Gaya in connection with Wazirganj (Tankuppa) P.S. Case No. 486 of 2015.
