In relation to a case lodged in 2001 registered under sections 409,420,467,471 and 120-B, the petitioner is now sought to be apprehended and hence prayer for anticipatory bail. The District Welfare Officer after making enquiry found that the government funds meant for the weaker sections of the society was embezzled by the Principal of the college in collusion with different Class III & Class IV employees of the Welfare Department. It appears that the name of the petitioner transpired in connection with the said case after a decade as, according to the prosecution, a sum of Rs. 2,400/- was found credited in the account of the petitioner.

Patna High Court Cr.Misc. No.53875 of 2016 (2) dt.21-12-2016 2/2 Counsel for the petitioner submits that the petitioner is not an employee of the government. The investigation is still going on. Another co-accused, not cited in the FIR, namely, Shambhu Prasad has been granted the privilege of anticipatory bail by this Court vide order dated 20.05.2016 (Annexure-2). The case of the petitioner is on identical footing. Having considered those submissions, let the petitioner above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in Laheriasarai P.S. Case No. 156 of 2001 on condition that one of the bailors of the petitioner shall be his own/close family member.

In the event of framing of charge, the petitioner shall appear in person on each date fixed at the trial. In case of default in doing so on two consecutive dates, the trial court shall have liberty to cancel his bail bonds and secure his arrest in accordance with law.
