JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-11-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 364 and 120B of the Indian Penal Code.

The prosecution case is that the brother of the informant Santosh Kumar was kidnapped when someone called the informant who was the Ward Commissioner of Buxar Municipality not to vote in the election of the Chairman of the Municipality supposed to be held on 3.8.2015. The caller claimed himself to be Sandeep Yadav. The petitioner was, at the relevant time, the Chairman of Buxar Municipality.

It is submitted by the learned senior counsel for the

Patna High Court Cr.Misc. No.53961 of 2015 (2) dt.27-11-2015 2/2 petitioner that even assuming the accusation no offence is made out against the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. It is further submitted that the victim returned suo motu next day of the occurrence and the victim has given statement before the police but he has not named the petitioner. Statement to that effect has been made in paragraph 10 of the petition.

Considering the nature of accusation and the petitioner being a lady, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Buxar in connection with Buxar (Town) P.S. Case No.316 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
