JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Runnisaidpur P.S. Case No. 603 of 2017, registered for the offences punishable under Sections 498(A) & 494 of the Indian Penal Code.
The case is under Section 498-A of the Indian Penal Code.
On appearance of the opposite party No. 2, the matter was referred to the Patna High Court Mediation & Reconciliation Center, vide order dated 01.08.2019. The report of Mediator is available on record at Flag "M" which disclosed that the dispute between the parties has been resolved through process of mediation and memorandum of agreement disclosed that the petitioner is ready to give Rs.5000/- per month for maintenance of his children in the bank account of opposite
Patna High Court CR. MISC. No.64621 of 2018(5) dt.03-09-2019 2/3 party No.2 Keeran Devi. Bank account no. 443010510000560 and IFC Code-BKID0004430 has been mentioned in the memorandum of agreement by end of second week of every month and opposite party no.2 has assured that she will not make any demand and she is ready to withdraw the cases filed against the petitioner.
Both the parties have admitted the above position. In view of the above, let the petitioner, above named, surrender before the learned Court below on 13.9.2019 with a bank draft of Rs.5000/- in favour of the opposite party no.2 and petitioner will be released on bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, in connection with Runnisaidpur P.S. Case No. 603 of 2017, subject to conditions as laid down under Section 438 (2) of the Cr.P.C. and further direction is that one of the bailors of the petitioners shall be a local persons having sufficient immovable property within the jurisdiction of the Court concerned with condition that petitioner will abide by the terms of the memorandum of the agreement between the parties at the above mentioned deposit shall be released in favour of the opposite party No.2 on his filing of application before the learned lower

It is also expected that opposite party No.2 shall also abide by the terms of agreement between the parties. Let a copy of Mediator's report along with the memorandum of agreement be sent to the Court concerned for needful.
