Heard the parties in virtual Court.

Petitioner seeks bail in a case registered for the offences punishable under Sections 30(A),32(2) and 41(1) of Bihar Prohibition and Excise (Amendment) Act, 2018. Petitioner is in custody since 14.06.2020. He was arrested from the vehicle on which liquor was being carried. Submission is that the petitioner is neither owner of the vehicle nor owner of the liquor. Petitioner has got no criminal antecedent. Investigation of the case is already complete.

Considering the nature of material and period already undergone by the petitioner, let the petitioner, above named, be

Patna High Court CR. MISC. No.8671 of 2021(2) dt.25-06-2021 2/2 released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Phulwariya Police Station Case No.137 of 2020 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
