JUSTICE SATYAVRAT VERMA ORAL ORDER 10-02-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in connection with Semra P. S. Case No.70 of 2021, instituted for the offences under Section 414, 34 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 28.06.2021, he is a person with clean antecedent and charge-sheet has been submitted in the case.

The learned counsel for the petitioner submits that the informant alleges that petitioner was arrested with a stolen motorcycle and he disclosed that he bought the motorcycle from Bishnu Kumar. Accordingly, Bishnu Kumar was arrested and he said that he does not remember from whom he had purchased the motorcycle. On his disclosure, one Ranjan Kumar Pandey

Patna High Court CR. MISC. No.52956 of 2021(2) dt.10-02-2022 2/2 was arrested with a stolen motorcycle.

The learned counsel for the petitioner submits that petitioner is a person with clean antecedent and he was not aware that the motorcycle was stolen one which he had purchased from Bishnu Kumar and he had gone to the garage of Bishnu Kumar for seeking the documents relating to the motorcycle when he came to be arrested.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody since 28.06.2021, he is a person with clean antecedent and charge-sheet has been submitted in the case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-III, Bagaha, West Champaran in connection with Semra P. S. Case No.70 of 2021.

The application stands allowed.
