Heard learned counsel for the petitioners as well as the learned APP for the State.

The petitioners apprehend their arrest in connection with Jogbani P.S. Case No. 136 of 2022, registered for the offences punishable under Sections 363 & 366 (A) of the Indian Penal Code.

As per allegation, Mithun Keshari and Chandan Kumar have kidnapped the daughter of the informant. The learned counsel for the petitioners has submitted

No.43629 of 2022(3) dt.11-01-2023 2/2 that the victim in her statement under Section 164 of the Cr.P.C. has stated categorically that she was in love and affair with Mithun Keshari and her parents were not happy with their relation. She with her own sweet will solemnized her marriage with co-accused Mithun Keshari.

On the other hand, Sri Shailendra Kumar, learned APP has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, V, Araria in connection with Jogbani P.S. Case No. 136 of 2022, subject to the conditions as laid down under Section 438 (2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
