JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-12-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner prays for regular bail in connection with Sachiwalaya P.S. Case No. 76 of 2017, registered for the offences punishable under Sections 384, 386, 120B of the Indian Penal Code and under Section 66 of the Information Technology Act.
Earlier prayer for bail of the petitioner was rejected vide order dated 14.09.2017, passed in Cr. Misc. No. 39023 of 2017, with an observation that he may renew his prayer for bail after framing of charge in this case.
Submission of the learned counsel for the petitioner is that now charge has been framed and he is in judicial custody
Patna High Court Cr.Misc. No.58989 of 2017 (2) dt.06-12-2017 2/2 since 13.06.2017 and has no criminal antecedent and further there is no direct allegation against the petitioner. Learned A.P.P. opposed the prayer for bail.
Having heard both sides, in view of the facts and circumstances and also in view of order dated 14.09.2017, passed in Cr. Misc. No. 39023 of 2017, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge-II cum Additional Chief Judicial Magistrate, Patna, in connection with Sachiwalaya P.S. case No. 76 of 2017.
This is subject to the condition that one of the bailor should be a local person having sufficient immovable properties within the jurisdiction of the court concerned and they will cooperate in the investigation and will appear before the investigating officer as and when required, failing which his bail bond shall be liable to be cancelled.
