JUSTICE RAKESH KUMAR ORAL ORDER 13-12-2016 After some argument, Sri Binod Murari Mishra, learned counsel for the petitioner, in presence of Sri Binay Krishna, learned Special Public Prosecutor for SC/ST Act, submits that since the petitioner is accused for committing offence under the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989, besides offence under Section 366(A) of the Indian Penal Code and in view of recent Division Bench judgment of this Court, the anticipatory bail petition after rejection of the bail from the court below may not be entertained. He makes a prayer for disposal of the present petition so that petitioner may file appropriate appeal under the provision of SC/ST Act. The prayer is allowed.

The petition stands disposed of.
