ANJANA MISHRA ORAL ORDER 09-11-2017 Heard learned counsel for the petitioner and the learned counsel for the informant as well as the learned counsel appearing on behalf of the State.

The petitioner is in custody since 10.07.2017 in connection with Chainpur P.S. Case No.03 of 2017 registered for the offence under Section 302/34 the Indian Penal Code and Section 27 of the Arms Act.

The sole allegation is against one Sudhar Yadav, who is alleged to have called the petitioner to his residence and subsequent thereto, the deceased was found dead in the field. Learned counsel for the petitioner submits that save and except that the petitioner is the brother of Sudhar Yadav,

Patna High Court Cr.Misc. No.51893 of 2017 (2) dt.09-11-2017 2/2 there is no material to indicate the connection of the petitioner in the present crime. He further submits that the petitioner is residing at Mughalsarai for the last 20 years and has in no way to do with his brother. The statement of the informant does not refer to the present petitioner.

Considering the aforementioned facts and circumstances and that the petitioner has clean antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Kaimur at Bhabua, in connection with Chainpur P.S.
