====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 15-11-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 323, 325, 307, 504, 506 and 34 of the Indian Penal Code.

The informant alleges that on 12.04.2022, the accused persons along with the petitioner and ten unknown accused came to his house, further Diwakar inflicted repeated subtle blow over stomach and chest of Budha Singh, the brother-in-law of the informant, further Sagar, Saurav, Ramnaresh and other also assaulted him on account of which he suffered multiple injuries, it is next alleged that

Patna High Court CR. MISC. No.43706 of 2022(2) dt.15-11-2022 2/3 petitioner along with other named accused persons assaulted the informant when he intervened to save his brother-in-law, it is further alleged that Buddha Singh died during the course of treatment.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and has been falsely implicated in the present case, it is next submitted that from bare perusal of the allegation as alleged in the FIR it would manifest that there is specific allegation against Diwakar of inflicting repeated subtle blow over stomach and chest of Budha Singh and thereafter, Sagar, Saurav and Ramnaresh have been specifically alleged of assaulting him. Learned counsel also submits that petitioner with general and omnibus allegation has been roped in the present case with an allegation that when informant intervened the petitioner along with other named accused persons also assaulted him.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the

No.43706 of 2022(2) dt.15-11-2022 3/3 event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Aurangabad P.S.
