Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Aurai P.S. Case No. 101 of 2020 registered for the offence punishable under Section 392 of the Indian Penal Code.

As per the F.I.R., prosecution case is to the effect that on 08.05.2020, the informant namely Shishir Kumar who is allegwed to run C.S.P. Centre of State Bank of India, had gone to S.B.I. Branch Aurai by his motorcycle, accompanied by his co-villager Bal Mukund (who happens to be his business partner in running the said C.S.P.), to withdraw Rs.4,50,000/- for his C.S.P. Centre. And while he was returning back to his C.S.P.

No.39774 of 2020(2) dt.10-02-2021 2/3 Centre by his motorcycle after withdrawal of the said amount, then at about 4.00 p.m on the way near bridge situated in between Sasauli and Simri he was intercepted by the motorcycle-borne three unknown miscreants who inflicted assault upon him (informant) and at gun point, snatched the said amount of Rs.4,50,000/- from his possession.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. He further submits that one mobile has been recovered from conscious possession of the petitioner. He further submits that similarly situated co-accused Upendra Sahni has been granted bail by a Co-ordinate Bench of this Court vide order dated 13.11.2020 passed in Cr. Misc. No.28944 of 2020. He further submits that till date, no T.I.P. has been conducted and he further submits that a sum of Rs.50,000/- has been recovered from the co-accused, namely, Umesh Sahni, who has been granted bail by this Co-ordinate Bench of this Court. He further submits that the petitioner has got no any criminal antecedent. Learned A.P.P. for the State opposed the bail petition. Learned court below is directed to verify the criminal antecedent of the petitioner and if there is no criminal antecedent, petitioner should be released on bail on furnishing
