Mr. Anjani Kumar, Senior Advocate Mr. Shailendra Kumar Singh, Advocate ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 20-09-2017 From the supplementary show cause filed by the University and the averment made therein in para 4, it is clear that the petitioner Sri Braj Mohan Sharma has expired on 07.03.2016 and thereafter the competent authority on 25.05.2017 has requested the Incharge Principal, Mahila College Khagaria to provide the details of the successors so that retiral benefits can be paid to the family members of the deceased petitioner. It is stated that based on the succession certificate, the claim of the family members shall be settled, but
Patna High Court MJC No.4060 of 2013(6) dt.20-09-2017 2/2 till date nothing has been done.
In view of the fact that the original petitioner has expired, liberty is granted to the legal heirs of the original petitioner Sri Braj Mohan Sharma to approach the Registrar of the University concerned along with relevant documents and material to show as to who are the legal heirs of the deceased employee and the University shall settle the claim of the legal heirs in accordance with law within a period of three months from the date of appearance of the legal heirs.
With the aforesaid liberty to the legal heirs, this application stands disposed of.
