The petitioner is languishing in custody since 09.09.2017 in a case for the offence registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The prosecution story, in brief, is that during checking of vehicle, the informant saw that the petitioner alongwith two white bags seated in the vehicle. On search, the police recovered 24 liters of foreign liquor from possession of the petitioner.
It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the
Patna High Court Cr.Misc. No.49641 of 2017 (2) dt.17-10-2017 2/2 petitioner. 24 liters of foreign liquor is said to have been recovered from possession of the petitioner. No compliance of Section 100 Cr. P.C. has been made in the present case.
On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge-cumAdditional Sessions Judge-4th, Kaimur at Bhabua, in connection with Mohania P.S. Case No. 485 of 2017.
