JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-11-2015 The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307,504,509 of the I.P.C and 27 of the Arms Act. The prosecution case is that the accused persons entered the house of the informant and tried to outrage the modesty of his mother and sister. On protest being made, the accused persons assaulted the informant when the villagers came to rescue they were also assaulted. It is specifically alleged against the petitioner no. 3 that he resorted indiscriminate firing. It has been submitted on behalf of the petitioners that the

Patna High Court Cr.Misc. No.53890 of 2015 (2) dt.27-11-2015 2/2 injuries were found simple in nature and two persons from the petitioners' side have also got injury. A statement has been made in Para 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid stand, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda in connection with Chandi P. S. Case No. 263 of 2015 subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Prakash/- U T
