JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 17-03-2021 A supplementary affidavit has been filed by learned counsel for the petitioner stating therein that the petitioner has one criminal antecedent, which is not mentioned in paragraph-3 of the bail petition.

Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State. The petitioner seeks bail in connection with Charpokhri P.S. Case No. 87 of 2020, G.R. No.2433 of 2020 registered for the offences punishable under Sections 504, 506, 386/34 of the Indian Penal Code.

The prosecution case is that one Sanjay Kumar submitted a written report before the Officer-in-Charge of Charpokhri P.S. on 01.06.2020 whereby and where under he has alleged that through the mobile numbers, the informant has been abused and given threatening to kill him. It is further alleged that upon call made by the informant, the caller have disclosed their name as Sonu Kumar, Narayan Pandey and Deepak Pandey.

Patna High Court CR. MISC. No.39802 of 2020(4) dt.17-03-2021 2/2 Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. On perusal of the F.I.R., it appears that the informant has paid Rs.98,000/- in two times to other co-accused namely Narayan Pandey as such nothing has been paid to the present petitioner. Allegation made in the F.I.R., rangdari has been demanded from aforementioned four mobile numbers but the said mobile number does not belong to the petitioner. He further submits that there is money dispute between the informant and Narayan Pandey. Petitioner is in jail custody since 14.07.2020. Learned A.P.P. for the State opposed the bail petition.

In the facts and circumstances of the case, let the above named petitioner be enlarged on bail after framing of charge on furnishing bail bond of Rs. 25,000/- (twenty five thousand) only with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Bhojapur at Ara in connection with Charpokhri P.S. Case No. 87 of 2020.
