The petitioner seeks bail in Kotwali P. S. Case No. 452 of 2018 instituted for the offence under Section(s) 417, 418, 419, 420, 466, 467, 468, 471 and 120B of the Indian Penal Code. Learned counsel for the petitioner has submitted that petitioner is not named in the written report. The name of this petitioner has come during investigation in the confessional statement of co accused Amitesh Kumar, who is named in the F.I.R. Thereafter, the police recorded the confessional statement of this petitioner. This fact is also mentioned in the impugned order . Learned APP for the State submits that co accused Amitesh Kumar in his confessional statement as mentioned in para 97 of the case diary has taken name of this petitioner .Thereafter, police has recorded confessional statement of this
Patna High Court Cr.Misc. No.61689 of 2018(3) dt.29-10-2018 2/2 petitioner in para 102 of the case diary. It has further been submitted that one of the co accused of this case with similar allegation has already been granted regular bail by coordinate Bench of this Court by order dated 8.10.18 passed in Cr. Misc. no. 60893 of 2018 In the written report there is allegation that password of the main server of the computer was with Assistant Programmer, namely, Amitesh Kumar and Arvind Kumar ( Exprogrammer). There is also allegation in the FIR against the incharge of the record room , namely Jata Shankar Mishra and his associate namely Ranjit Mishra.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM,Patna, in connection with Kotwali P. S. Case No. 452 of 2018 subject to the condition that both the bailers shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U T
