The petitioner apprehends his arrest in connection with Complaint Case No. 1879 (C) of 2017, registered under Sections 323, 342, 498(A), 406 and 504/34 of the Indian Penal Code and Section 3 / 4 of Dowry Prohibition Act. The accusation is of torturing of complainant for demand of cash of Rs. 1,50,000/- to purchase the four wheeler. Thereafter, parents of the complainant, anyhow, gave cash of Rs. 1,50,000/- to her mother-in-law in presence of her family members, but in spite of that she was tortured in her matrimonial house.
Patna High Court CR. MISC. No.40442 of 2019(6) dt.27-09-2019 2/2 Learned counsel for the petitioner submits that complainant/O.P. No.2, who is wife of petitioner has already filed Maintenance Case No. 06 of 2018 in the Court of Principal Judge, Family Court, Begusarai in which she is getting interim maintenance of Rs. 7000/- per month by the petitioner. Further submission is that, while the notice, as issued to the O.P. No.2 was received by her father in spite of that she did not take any pain to appear in this case. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Begusarai in connection with Complaint Case No. 1879 (C) of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
