The petitioner is in custody in connection with Bisfi P.S. Case No. 150 of 2017, a case under Sections 395 and 397 of the Indian Penal Code.

The F.I.R. is against unknown. The petitioner was arrested on 28.06.2017, which has wrongly been typed as 28.07.2017 in paragraph-16 of the bail petition, as has been submitted by the learned counsel for the petitioner. The petitioner was never put on Test Identification Parade. Only material against the petitioner is the confessional statement of co-accused.

Submission is that the recovered currency from the possession of the petitioner does not connect to be part of the

Patna High Court Cr.Misc. No.60793 of 2017(3) dt.13-02-2018 2/2 looted property and during whole of the investigation, the same was not put on Test Identification Parade.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
