Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections304(B), 201/34 of the Indian Penal Code. It is alleged in the F.I.R that sister of the

Patna High Court CR. MISC. No.39563 of 2020(3) dt.27-10-2021 2/2 informant was killed by setting her on fire by the in-laws family including the petitioner for non-fulfillment of dowry demand. The victim in her dying declaration has also corroborated the prosecution version.

It is submitted by learned counsel for the petitioner that petitioner is father-in-law of the victim and the victim died due to the accidental burn injury after leakage in the gas cylinder.

Considering the fact that the victim in her dying declaration has corroborated the prosecution version and subsequently died, this Court is not inclined to grant privilege of anticipatory bail to the petitioner. The prayer for anticipatory bail of the petitioner stands rejected.
