The S.P. Sitamarhi in compliance of oral orders of the Court is present in person. The S.P. very fairly submits

Patna High Court CR. MISC. No.37738 of 2022(4) dt.08-12-2022 2/3 that after investigation it has been found that petitioner was not present at the place of occurrence and thus has been found innocent.

Considering the submissions made by the S.P. Sitamarhi and taking into consideration the order dated 12.09.2022, the petitioner in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Pupri P.S. Case No. 16 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

The personal appearance of the Superintendent of Police, Sitamarhi is dispensed with.

Learned counsel for the petitioner after some arguments seeks permission to withdraw the anticipatory bail application. Permission is accorded.

In the event, if any regular bail application is filed by the
