JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 12-12-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Jogapatti P.S. Case No. 181 of 2017 registered under Sections 341, 342, 323, 354, 370, 504 and 506/34 of the Indian Penal Code.

The petitioner is said to have snatched the nose pin of the daughter of the informant and took her to his house along with his family members and tied her with the peg and assaulted her.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case due to land dispute. The allegation levelled against the petitioner is not

Several notices were issued to the informant to produce the victim for her medical examination and recording her statement under Section 164 Cr.P.C., but in vain which goes to negate the prosecution case. The petitioner has been languishing in custody since 02.06.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge-cum-Special Judge, under POCSO Act, West Champaran, Bettiah in connection with Jogapatti P.S. Case No. 181 of 2017.
