JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-05-2021 At the outset, Mr. Sunil Kumar, the learned counsel for the petitioner makes an oral request of amending the name of the petitioner. By Inadvertence, the name of the petitioner has been typed as "Vikash Kumar" though his name is "Vikash Sharma".

The impugned order also depicts the name of the petitioner as "Vikash Sharma".

Let the name of the petitioner be read as "Vikash Sharma".

Heard Mr. Sunil Kumar, learned counsel for the petitioner and Mr. Mr. Ram Priya Sharan Singh, learned APP for the State.

Patna High Court CR. MISC. No.39162 of 2020(2) dt.03-05-2021 2/3 The petitioner seeks bail in anticipation of his arrest in connection with Sarai P. S. Case No. 336 of 2019, dated 20.09.2019, instituted for the offences under Sections 467, 468, 471, 420, 504, 506 and 34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that the present case has been lodged because of family dispute. The petitioner is the nephew of the informant. Earlier also, a case was lodged against the relatives of the petitioner by the informant vide Sarai P. S. Case No. 36 of 2020.

The allegations in the F.I.R. clearly reflect that there is a dispute regarding property amongst the members of the same family.

One of the similarly situated accused persons has been granted anticipatory bail by this Court vide order dated 15.07.2020 passed in Cr. Misc. No. 18631 of 2020.

Considering the afore-stated facts, the

No.39162 of 2020(2) dt.03-05-2021 3/3 petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate - XVI, Vaishali at Hajipur, in connection with Sarai P. S. Case No. 336 of 2019, subject to the conditions as laid down under Section 438 (2) Cr.P.C. and also subject to the confirmation that the petitioner's name is Vikash Sharma.

The application stands allowed.
