The petitioners seek bail in Banka (Barahat) P.S. Case No. 353 of 2013, registered for the offences punishable under Sections 328, 302/34 of the Indian Penal Code. The informant, father of the deceased made allegation that his daughter Vandana Devi was married to Uttam Kumar Roy who died four years ago before the occurrence. All the accused persons poisoned his daughter to death. The informant further stated that his daughter got three sons. Learned counsel for the petitioners submits that the petitioners are father-in-law and brother-in-law of the deceased. There is no specific allegation against the petitioners. No.34689 of 2014 (3) dt.16-01-2015 of the witnesses have stated that on account of some quarreling the victim herself consumed poison and some of the witnesses disclosed that on account of quarreling with the mother-in-law and sister-in-law they might have poisoned the victim. Considering the facts aforesaid and nature of allegations, and the fact that the petitioners are in jail since 31.05.2014, the petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Banka (Barahat) P.S. Case No. 353 of 2013.
