2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 341, 323, 354, 307 and 379/34 of the Indian Penal Code.

3. The case of the prosecution in short is that the petitioner has pulled the dupatta of the informant and thereupon there has been scuffle between family members. There is allegation that other persons have assaulted the family members.

4. Learned counsel for the petitioner has submitted that there is also a counter version of this case which has been filed prior to this case with same kind of allegations. Learned counsel for the petitioner has submitted that from perusal of the injury report it will transpire that the nature of injury is simple. It has also been argued that during investigation, the

Patna High Court CR. MISC. No.50130 of 2025(3) dt.16-10-2025 2/2 Supervising Officer has directed the I.O. not to file case under Section 307. The petitioner is a man of clean antecedent and is in judicial custody since 22.04.2025.

5. Learned Additional Public Prosecutor for the State has vehemently opposed the prayer of bail to the petitioner.

6. The nature of allegation is general and omnibus and only allegation against the petitioner is that of snatching dupatta of the informant. There is case and counter case.

7. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Banka P.S. Case No. 196 of 2023 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Banka. (Ashok Kumar Pandey, J) durgesh/- U T
