The petitioners being the brother, mother, brother's wife and sister of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code. The accusation is of killing the sister of the victim after four years of marriage for non-fulfillment of dowry demand. It is submitted by learned counsel for the petitioners that the accusation is omnibus and general. In fact, the victim died natural death on 12.09.2015. Admittedly, as per own admission of the informant in the written report, he came to know about the alleged occurrence on 13.09.2015, but the FIR was

Patna High Court Cr.Misc. No.53080 of 2015 (2) dt.23-11-2015 2/2 registered on 16.09.2015. Moreover, the thrust of accusation is against the husband of the victim, who is in custody. Considering the thrust of accusation against the husband of the victim, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Kaimur at Bhabua in connection with Mohania P.S. Case No.360 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
