JUSTICE ARVIND SRIVASTAVA ORAL ORDER 30-11-2017 Heard learned counsels for the petitioners and the State. Petitioners apprehend arrest in connection with Sahebganj P.S. Case No. 37 of 2014 registered for the offence punishable under sections 302, 201, 498A of the Indian Penal Code. Learned counsel appearing for the petitioners submits that petitioners have been falsely implicated in this case. Petitioner nos. 1 and 2 are own brothers. The daughter of the informant was married to petitioner no. 2. It is further submitted that the daughter of the informant was having love affair with some other person and has left this petitioner on her own will and went with her lover. The informant had full knowledge of the aforesaid fact, however only with a view to save his prestige in

Moreover, the victim lady appeared before the Court below and gave her statement to the effect that she has married someone else, which is evident from the order-sheet of the Court vide annexed as Annexure-5 to the supplementary affidavit filed on behalf of the petitioner. Petitioners have no criminal antecedent. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioners, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, West, Muzaffarpur in connection with Sahebganj P.S. Case No. 37 of 2014 subject to the conditions laid down under section 438(2) Cr.P.C. (Arvind Srivastava, J) mcv/- U T
